3pm Turns 3 Years Old

Three years ago an idea was born around bringing music to the web in a free, organized, and easy way. 3pm is that idea, and it is still alive. I learned a lot from working on the 3pm project from the very beginning. How much work was involved in keeping links up to date, how not to tangle certain legal business practices with certain "illegal" creative works, and most importantly how much I love music as an art form.

I made a few cool friends along the way, but tons of enemies also. At first, the adversity of what 3pm brought to my very door drove me even harder and I accepted the challenge with a passion I had never known. It suddenly somehow grew into more of a chore that I made myself do. I think that's when I needed to take a step back from things to see that my new passion for the 3pm movement had clouded my ability to enjoy and appreciate music as an art form. I let 3pm to itself for awhile and started just doing 3pm Injections and it seemed a lot easier for me to work with, but recently the "haters" caught up with me again. This time I couldn't fight what was happening. Entire blog posts were being removed by Google themselves.

Here we are once again. My love for music is stronger than ever, and the 3pm legacy will continue. I will breath life into 3pm so long as I am able to breathe. I've been itching to do an update to the 3pm site lately, and a lot of links are in need of repair. So as we journey into the third year of 3pm's existence on the web, I just want to say thanks for everyone's interest in the idea and Happy Birthday 3pm.

3pm is getting a bit long in the tooth these days, and it's looking to be about that time to break up the single site into multiple pages. It may not happen in the next update, but we're working on the concept of a multi-page 3pm as you read this. The reason we've decided to make the change is due to the growing number of people telling us that the site takes too long to load on slower connections. Of course we've had some concern about this issue early on, and for a while, the size of 3pm wasn't really large enough to distribute it over multiple pages. My how 3pm has grown since then!

So, look for the new version to launch soon, but for those that don't like change, we're keeping 3pm LITE just the way it is but with a little something special added as a bonus. ;)

Wow, this past week has been a crazy one. Updated the site a bit, got some pretty nasty email, and lost my AdSense account (for good). So now, 3pm is going strictly donation supported and ad free. It's pretty sad when some mouse clicking monkey can still cause trouble for people these days. I still think Google AdSense is the best, and hope anyone using the service never has to go through what I went through.

Anyways, we added a ton of music this week, and as always, there's more where that came from. Enjoy.

3pm has made a few people out there quite angry these days. Apparently angry enough to get my Google AdSense account disabled. Shortly after I get the email notice from Google about my account, I get two emails from two (different?) people claiming responsibility for the act. I'd present the messages here, but there's about as much non-vulgar content in them as there are ads on my sites at the moment.

Never the less, the reasoning I got out of the pretty nasty emails is that the person(s) racked up a pretty hefty web host bill because of 3pm's direct linking to mp3 files on their company's site. However, it was the second email that raised a bit of suspicion about who I was dealing with. I got the feeling that this was more of a competitor that was frustrated that they were loosing revenue due to our apparent popularity.

Now, I don't have a problem with individuals requesting links removed from 3pm, and we've been quite responsive in taking down unwanted links to mp3 files in the past. But when it comes to being bullied by competing services, through malicious attacks on our modes earning a little change now and then, we draw the line. Needless to say, we're moving to a donation-based system for 3pm and 3pm Overdose from here on out, and we'll give Google all the information necessary to settle the AdSense situation.

So on a more humble note, I'd like to thank everyone for all the support you've given us as we've grown. We can't thank you all enough for the submitted links, suggestions, and comments we have received. Keep them coming. We hope you continue to enjoy the 3pm experience...

Pay 30% More For Apple And EMI To Trust You

Now before everyone comes down on me about how "great" a deal this actually is, I have one simple question about this new "deal" Apple and EMI have to offer. Would you really give your trust to a company that's planning to sell you its trust?

Aside from being of higher quality sounding music, you'll get to listen to your music on more of your devices (which you should be able to do anyway), and that's cool. But something seems pretty fishy about the way Apple and EMI is going about this whole thing, but maybe I'm just paranoid.

The best part about this new is that you won't get completely screwed over immediately.
From the EMI Press release:

"Complete albums from EMI Music artists purchased on the iTunes Store will automatically be sold at the higher sound quality and DRM-free, with no change in the price."

But...

"Consumers who have already purchased standard tracks or albums with DRM will be able to upgrade their digital music for $0.30/€0.30/£0.20 per track."

So you had better have bought that whole album, or you're getting the short end of the stick on this "deal" anyways. Over all, this new offering is definitely a step up in terms of the user's freedom to actually use what they pay for, and will most certainly shake things up on the DRM battlefront.

Happy Birthday 3pm!

It's been a year since we started this little music experiment, and my oh my how it has grown. 3pm started out as a personal music page for myself, a way to keep track of the all the cool free mp3 links I happened to find while surfing the web. Then my family and friends found out about it and began requesting links themselves. As it has grown over these past months, I've discovered cool new music and entire new genres that I would have never knew about without this phenomenon. I've even met lots of cool new people, some of whom I now call my friends. It's been a great success in my eyes so far, and I can only thank the many people serving up all this great music and the people that (have and continue to) support this awesome idea.

Here's to many more years of the 3pm experience.

RIAA fights to keep wholesale pricing secret [Ars Technica]

- So let me see if this makes sense. The RIAA is suing people for several hundred dollars per shared song, but are unwilling to disclose pricing information that could determine the justification of the seemingly excessive amounts sought by the RIAA. I think the RIAA are beginning to make up in lawsuits where they're lacking in actual sales earnings these days.

We're talking about works that immediately and rapidly depreciate in value as soon as it makes it's way to the Internet anyway.

Australia court: link to copyrighted material, feel the wrath

Bloggers, MySpacers, and anyone else who links to copyrighted material without permission is fair game for legal action, a court in Australia has ruled. Not "hosts," not "uploads," not "downloads," but "links to." If that precedent were adopted worldwide, there would be no Google, no Wikipedia, no internet as we know it. Universal Music, Warner Music, Festival Records, EMI and BMG were among the companies who sued:

A full bench of the Federal Court yesterday upheld an earlier ruling that Stephen Cooper, the operator of mp3s4free.net, as well as the internet service provider that hosted the website, were guilty of authorising copyright infringement because they provided a search engine through which a user could illegally download MP3 files. The website did not directly host any copyright-protected music, but the court held that simply providing links to the material effectively authorised copyright infringement.
"Mr Cooper had power to prevent the communication of copyright sound recordings to the public in Australia via his website," the judges said. "He had that power because he was responsible for creating and maintaining his mp3s4free website."
Ms Sabiene Heindl, general manager of Music Industry Piracy Investigations (MIPI), said similar action could be taken against individuals who, like mp3s4free, used the internet to link to copyright-protected material. [She] said that this could apply even if a person had embedded a copyright-infringing YouTube clip in their blog or MySpace page.
"We don't make any distinctions between big websites or small websites", she said, adding that MIPI would consider individual blogs on a "case-by-case basis as to whether it would be appropriate to take action".

It's a sad day for many today as CNET reports that James Kim, the CNET editor who had been lost in the Oregon wilderness for the last 11 days, has been found deceased. Kim's wife, Kati, and daughters, Penelope (4 years) and Sabine (7 months), were rescued on Monday thanks to his very courageous and heroic efforts. Our heartfelt condolences go out to the Kim family and friends.

There's lots of great music out there for the taking, but it's not always easy to find. Here's my list of the ten best sites [in no particular order] to get great music delivered directly to my ears. Some of them are legal, some are in a "gray area", and then some flat out disregard the laws entirely. My thoughts are to use the ones you like and leave legality and morality to the judgmentals.

The Hype Ma chine - Great music blog content aggregator that offers various music streaming and playlist options. Find out what songs everyone is talking about.

3 pm - Of course there's our very own MP3 download/streaming site that grabs a ton of music from around the Internet and sorts it into a single, easy to navigate, page.

G2P - This little tool uses Google search for finding MP3 files around the web.

Jamendo - Find great music from artists who publish their works under the Creative Commons license. Allows you to stream or download entire albums in Ogg or MP3 formats.

Surch - Cool, and relatively new, search engine that works for you to find MP3s and other audio formats of music you want to hear.

OverClocked ReMix - Mix it up with MP3 downloads of video and computer game music remixed in unique and interesting ways to bring you into the music you remember from the games you love.

Singingfish - A great audio/video search engine that provides various search filtering options to help you find tons of audio and video files.

Inernet Archive: Audio Archive - Find tons of audio files you thought were lost to the ages and even upload your own works to make it available for generations to come.

KOhit - Another great place to find and download MP3s as well as song lyrics.

MP3tunes + Sideload - Like a dynamic duo, MP3tunes provides the space to backup, sync, and listen to your digital music collection, while Sideload provides thousands of free music tracks to jam into your MP3tunes locker.

Instead of breaking the DRM (something he'ss already done), Jon has replicated it, and wants to license the technology to companies that want their content (music, movies, whatever) to play on Apple devices.

Could We See Zune Sell For $99?

There's some interesting speculation going on about Microsoft possibly subsidizing the Zune in order to gain market share and reach a critical mass needed to dig in to Apple's dominant iPod sales. It's a great idea, but the likelihood of Microsoft pulling something this "intelligent" seems quite slim to me. That said, it may be the only logical way for the Zune to become the "iPod killer" it's been hyped up to be.

Beyonce album sales fall after 'black' comments - Pop star Beyonce Knowles has sparked controversy by saying she only makes records for black people. Since the Deja Vu singer made the astonishing statement sales of her new album, B'Day, have fallen by 70 per cent in the US. We did an emergency update to help everyone separate the good mp3 links from the bad ones, and we are working hard to get some new music for you. Opening Pandora's Box

Life Hacker has a list of 15 ways to get more out of Pandora that's pretty handy, there's even more tips in the comments that are worth checking out as well. I especially like the last part about riping and saving mp3 files from Pandora. But being an Ubuntu user now for a few months, I found an easier way to get and rename the mp3s it spits out that I like.

I found that the files show up in the /tmp folder as plugtmp-1, plugtmp-2, etc. or sometimes in the sub folder plugtmp. In order to keep Pandora from covering it's tracks on your hard drive, you can rename the files to what ever you like [as long as it's not one of the default names] and it will be there for you to listen to or move anywhere you want. I'm pretty sure this works in other Linuxdistros as well. Just make sure you refill your Karma meter by buying the CD or song from the artist you like every now and then.
